1. Agreement.Barkeep Sensors (the “Service”), the mobile app, the web app at app.barkeepsensors.com, and related cloud services, is provided by Mule Labs, LLC (“Mule Labs,” “we,” “us”). By creating an account or using the Service you agree to these Terms. If you use the Service for an organization, you agree on its behalf.
2. The service. The Service monitors equipment conditions (temperature, pressure, and related data) reported by Barkeep gateway and sensor hardware and delivers the alerts you configure. It requires compatible Barkeep hardware, provided separately. Cloud monitoring and alert delivery are included with the hardware; features may change over time.
3. Your account. Provide accurate information, keep your credentials secure, and take responsibility for all activity under your account, including members you invite to your organization and the access level you grant them. Tell us of any unauthorized use.
4. Acceptable use.Don't misuse or interfere with the Service; attempt to access another organization's data; reverse-engineer or copy the Service; use it unlawfully; or add another person's phone number or email as an alert contact without their permission.
5. Alerts and reliability, please read. The Service provides monitoring and alerts on a best-effort basis. Delivery depends on factors outside our control, including device power and placement, sensor and gateway function, WiFi/cellular and internet connectivity, your phone's notification settings, and third-party providers (Apple, Twilio, SendGrid, Particle, Supabase). Alerts may be delayed, undelivered, or inaccurate. The Service is an aid to, not a guarantee of, or a substitute for, proper equipment maintenance, staffing, supervision, insurance, and independent safeguards. Do not rely on the Service as your sole protection against equipment failure or product loss.
6. Hardware. Barkeep gateway and sensor hardware is provided under separate terms. These Terms govern the app and cloud Service, not the hardware itself; any hardware warranty is separate.
7. Third-party services. The Service depends on third-party providers (see §5 and the Privacy Policy). Their availability and terms are outside our control, and we are not responsible for their acts, omissions, or outages.
8. Intellectual property. Mule Labs owns the Service, its software, and the Barkeep Sensors branding, and grants you a limited, non-exclusive, non-transferable license to use the Service for your business. You retain your data; you grant us the rights needed to process it to provide the Service, as described in the Privacy Policy.
9. Termination. You may stop using the Service and delete your account at any time (Settings → Delete Account). We may suspend or terminate access for violation of these Terms or misuse. On deletion, your data is removed as described in the Privacy Policy.
10. Disclaimer of warranties. The Service is provided“AS IS” and “AS AVAILABLE,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that alerts will be delivered.
11. Limitation of liability. To the fullest extent permitted by law, Mule Labs will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, spoiled or lost product, business interruption, or loss of data, arising from or related to the Service, even if advised of the possibility. Our total liability for any claim will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim, or US $100.
12. Indemnification. You will indemnify and hold Mule Labs harmless from claims arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right (including adding contact details without permission).
13. Changes.We may update these Terms. If we make material changes we'll update the effective date; continued use means you accept the updated Terms.
14. Governing law. These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law rules, and any disputes will be brought in the state or federal courts located in Clark County, Nevada.
